Planning Obligations

How the Calculations are Done

This should be read in conjunction with the guidance provided in the Planning and Obligations in Lancashire Policy Paper.

Transport

The transport contribution for residential development is calculated based on estimates of how many people will be living in the new development (based on the number of bedrooms). For commercial development it is based on the gross floor area. In addition the level of accessibility is included as a sliding scale with developments in more accessible areas requiring lower contributions than in areas where significant transport improvements may be needed. The accessibility of the site is calculated using the accessibility questionnaire.

Contributions will not normally be sought for residential developments under 10 dwellings and for commercial developments (A1, B1(a), A2, B2 and B8) under 1,000m 2 gross floor area. All other land uses will be dealt with on a case by case basis.

Education

Planning contributions will be sought from residential properties for educational facilities, such as additional classrooms, where existing schools within a 2 or 3 mile radius are projected to be over-subscribed in excess of 10 percent, above their net capacity as a direct result of the residential development.

Any need for community facilities (including health/sport) to be provided at school premises should be considered under the relevant methodologies for these topics.

Where substantial new housing developments of over 150 dwelling are proposed the Education Authority will analyse whether there is a requirement for a completely new school. In such cases the developer would be expected to pay for all associated costs, including the land on which the school will be constructed.

Contributions will not be sought in the following circumstances:

Library Services

Planning contributions will be sought from residential properties towards the capital cost of providing new or upgraded facilities where existing libraries are identified as being at or above capacity (Accrington, Burscough, Padiham, Poulton-le-Fylde, Preston Central, Rawtenstall and Rosegrove in Burnley). The sum is calculated on the basis of all new dwelling units as each is assumed to make an incremental impact on demand. Contributions should be made for all new development within a 3km radius of the libraries listed above.

Where substantial new housing developments of over 150 dwellings are proposed the developer will be expected to contribute to any additional investment required to provide facilities in locations where there are no libraries within 3km.

Waste

Planning contributions will be sought from residential properties towards the cost of the new waste management network. Contributions are based on the capital cost per household of the new network.

The waste contribution is calculated based on estimates of how many people will be living in the new development. A contribution of £480 per dwelling is required for all developments of 10 or more dwelling units.

Youth and Community

Planning contributions will be sought from residential properties (2 or more bedrooms) towards the capital cost of providing new or upgraded facilities in areas of identified need ( Carnforth, Eccleston (Chorley), East Preston, Nelson Youth Centre and Star Youth Centre (Ashton, Preston)). Contributions will be requested for all residential developments of 10 or more dwellings in areas of identified need.

Where substantial new developments of over 150 dwellings are proposed, developers will be expected to contribute to any new capital investment where there are no community facilities within a safe 30 minute walk time or 2 mile radius plus funding of the first 2 years' revenue costs.
